The charges against Singh fall under Section 125 of the Representation of the People Act 1951, which prohibits promoting enmity between classes in connection with an election.

The police took suo-motu action after a video clip of Singh’s speech targeting a specific community surfaced on social media.

The speech is said to have taken place during a party meeting at a community hall in Maharajgunj.
