Jammu & Kashmir, July 14: A special National Investigation Agency (NIA) court has issued a non-bailable warrant (NBW) against Lashkar-e-Taiba (LeT) chief Hafiz Saeed in connection with the Pahalgam terror attack case.
Although the warrant was issued on July 8, details of the court’s order became public later.
The NIA, which is investigating the terror attack, filed a supplementary chargesheet before the special NIA court on July 6 against Hafiz Saeed, the chief of the Pakistan-based terrorist organisation Lashkar-e-Taiba (LeT).
The agency invoked provisions of the Bharatiya Nyaya Sanhita (BNS) and the Unlawful Activities (Prevention) Act (UAPA) while naming Saeed in the case.
After examining the chargesheet, the special court observed that there was sufficient material to proceed against the accused, accepted the chargesheet for trial and issued a non-bailable warrant.
As Hafiz Saeed is believed to be in Pakistan and is not in Indian custody, the trial can proceed under the provisions of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023.
Section 356 of the BNSS, which came into force in 2024, permits courts to conduct a trial in absentia in certain cases involving absconding accused persons, allowing legal proceedings to continue even if the accused does not appear before the court.
The NIA continues its investigation into the Pahalgam terror attack while pursuing legal proceedings against those allegedly involved in the case.
